Investors and real estate agents often ask Ron Ballard, “how can I ask you quick questions about real estate investment strategies and compliance?” The simple answer is to become a member of one of the Real Estate Strategies Institute’s support programs. Both programs currently include access to the same members forum for both California and national issues. This isn’t just a “community” forum, but it’s the platform where Ron Ballard receives questions and answers them on a group basis — which also builds up a large store of information. (It simply can’t get too state-specific outside of California or too deal specific, as those are handled through the Ballard Law office.)

Frankly, many members renew monthly simply for the forum. It’s like getting more than an hour of legal advice each month for about the cost of 10 minutes of attorney-client time.

With all the revelations about bank fraud and mistakes in processing pre-foreclosure procedures and demands for freezing foreclosures from different regulators and attorneys general, as well as insecurity about MERS, many commentators (including me) are expecting that banks will “have to” become more short sale friendly — even for investor based short sales.

The time and costs for the steps they will need to take to fix the mistakes and to comply with State recording laws (vs. likely illegalities in using MERS) are just too great when compared to voluntary liquidation through short sales.

So if you have been shy in pursuing short sale resales, or if you had been backing away from them due to some of the negative press, I believe now is the time to put that aside and get back into the pool.

Every business strategy needs some start-up time. Now is the time to start or re-start your short sale resale business and to prepare for additional strategies such as funding your deals with private money to manage longer holds and rehabs and with buying the notes from smaller banks (maybe we’ll put together a group to buy them from bigger banks) so you don’t have to negotiate junior liens. You see, RESI will not be limited to just short sales. We are here to support a growing number of real estate investment and entrepreneurial strategies.

The California-specific program includes the complete set of forms to supplement the CAR forms for investor-based, short sale quick-turn resales (“flips”). Only nationally consistent, generic forms for limited purposes are included in the National Issues/Generic membership. More national/generic forms will be added each month but these forms will need to be reviewed for compliance in other States with an attorney admitted in that State who knows creative real estate investing. Both programs include the same members’ forum and other support systems.

If you are doing business in California, you need to choose the California system. There is no substitute or short cut in our crazy State, plus it includes the National/Generic content. If you are doing business in other States, it would be good if you are also involved in a training program from one of the reputable trainers I network with.
